Does my mother-in-law need to own the mobile home to claim business use for personal residence?
Manufactured Homes March 4th, 2010She is filing a joint return with her husband, who does own the mobile home. She runs a daycare out of the home.
They just married June 2007, so I don’t know if community property laws play into this. Both lived in WI for the entire year of 2007.

If they’re married, they should file jointly because that is almost always more advantageous. Then it wouldn’t matter whose home it is!
You do not have to own your home to claim business use of your residence, but you must have home expenses. For instance, when I was renting an apartment I could claim a portion of my rent and utilities as business use.
