can i put a modular home on prpoerty that has a lien on it for owed back taxes?
Modular Home Questions September 5th, 2009My father owns 6% of property that he and my grandmother(now deceased) purchased. We would like to place a modular home on the property but he owes back taxes and they placed a lien on his 6% of the property. Can we still place a modular with his lien on the property?
My deceased grandmother owned the other 94% and he owes the IRS the back taxes.

It would not be a wise decision to build on property with a lien on it. I would pay the lien off and have a clear title to the property before considering building on it.

Yes. At some time in the future you may have to pay of the lien amount.

depends on local codes for the plot. But do not make it a permanent fixture as it will have a lien that will cloud your title

For starters he needs permission from the person or people who own the other 94%. Then, yes he still owns the property and he (and the other owners) can obtain permits and use it in anyway that local zoning laws allow. Just be aware that if the property is foreclosed on they can take the mobile home too.
PS. Is the lien placed by the county for unpaid property taxes, or was it placed by the IRS for unpaid income taxes?

A modular home is treated the same as a site built home. So unless you have the cash to pay for the home, financing will involve a conventional mortgage and to do that you need to own the land. Even if you pay cash for the home, it’s very risky affixing it to land you don’t own. BTW, the tax lien is on the property, not your father’s 6% interest. At some time the land can be sold for non payment of taxes. Another reason not to place your modular home on the site.
